1 Acceptance of Terms
By accessing, installing or using FaaturaCloud ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.
These terms apply to all users, administrators and any party who accesses the Platform under a FaaturaCloud licence.
2 Platform Usage
FaaturaCloud is licensed for use in business operations including cost estimation, quotation management and invoicing. You may use the Platform for lawful business purposes in accordance with these terms.
You may not:
- Use the Platform for any unlawful or fraudulent purpose
- Attempt to reverse-engineer, decompile or extract the source code of the Platform
- Resell, sublicense or redistribute the Platform to third parties without written consent
- Use the Platform in a way that violates applicable laws or regulations
- Attempt to gain unauthorised access to systems or data
3 User Responsibilities
As a FaaturaCloud user, you are responsible for:
- The accuracy and legality of all data entered into the Platform
- Ensuring your use of the Platform complies with applicable local laws, including UAE VAT regulations
- Maintaining the confidentiality of your login credentials
- Notifying us immediately of any suspected security breach or unauthorised access
- Keeping your contact and billing information up to date
4 Account Security
You are responsible for maintaining the security of your account credentials. FaaturaCloud will not be liable for any loss or damage resulting from unauthorised access to your account due to failure to maintain secure credentials.
We recommend using strong passwords and restricting access to authorised personnel only.
5 Subscription & Licensing
FaaturaCloud is provided under a deployment licence model comprising:
- One-Time Setup Fee: Covers initial deployment, configuration and onboarding
- Annual Licence: Provides continued access to the Platform, updates, security patches and support
Licences are non-transferable and specific to the business entity specified at the time of deployment. Renewal of the annual licence is required to continue receiving updates and support.
6 Support & Maintenance
Support and maintenance are provided to active licence holders. This includes:
- Bug fixes and security patches
- Platform updates and improvements
- Technical support via email and WhatsApp during business hours
Support does not cover issues arising from modifications made by the customer or third parties to the Platform.
7 Service Availability
For managed hosting deployments, we aim to maintain high availability of the Platform. Scheduled maintenance and unforeseen outages may occasionally affect availability.
For self-hosted deployments, service availability is the responsibility of the customer's own infrastructure. We provide reasonable assistance for server-related issues under active support agreements.
8 Intellectual Property
FaaturaCloud, its source code, design, features and documentation are the intellectual property of Bit & Byte Lab. All rights are reserved.
Customer data — including all quotations, invoices, client records and cost estimates created within the Platform — remains the sole property of the customer.
9 Limitation of Liability
FaaturaCloud and Bit & Byte Lab shall not be liable for any indirect, incidental, special or consequential damages arising from the use or inability to use the Platform, including but not limited to loss of business, revenue or data.
Our total liability in any matter arising from these terms shall not exceed the amount paid for the licence in the 12 months preceding the claim.
10 Termination
Either party may terminate the licence agreement with reasonable written notice. Upon termination:
- Customers will be given reasonable opportunity to export their data
- Access to managed hosting deployments will be suspended after the notice period
- Self-hosted deployments remain functional but no further updates or support will be provided
FaaturaCloud reserves the right to terminate access immediately in cases of breach of these terms.
11 Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these terms shall be subject to the jurisdiction of the courts of the UAE.
